got a section 59 again today :( the police round here are pathetic, i was going 20 in an empty car park to park up and go and see someone. :( well annoyed lol got no money now so tyres will have to wait even longer :(

but, one of my friends said that the police/community soppurt people cant drive your car without permission, but he drove it! without my permission obviously, just wondering if theres anything i can do and if its worth doing anything? lol

wait you were driving 20 in a carpark and they pulled you for that? how pathetic! isnt a car park say for like a supermarket privatly ownd and only they can enforce the speed?

it was a multi storey as it was raining so was meeting someone there, apparently its was antisocial driving or something like that

Where an officer has reasonable grounds for believing that a motor vehicle is being used in a manner which contravenes
Road Traffic Act Section 3 (Careless Driving) OR Section 34 (Driving elsewhere than on a road) AND also the manner of
use of the vehicle is causing or has been causing or is likely to cause, alarm distress or annoyance to members of the
public, Section 59 can be used to:-

initially give a written warning (valid for twelve months)

(commonly called a Section 59 Notice)

and on a subsequent occasion to seize the vehicle.

(it will probably end up in the crusher, or may be ransomed back to the owner)

A constable in uniform has the power to order the person driving to stop the vehicle, to seize and remove the vehicle, to
enter any premises on which the officer has reasonable grounds for believing the motor vehicle to be and to use
reasonable force. Seizure can made only if a warning has been given, or believed to have been given, or if a warning
is clearly being ignored.


Unless they really dont like you, your missing something out? you look like a drug dealer??

As it states only a uniformed officer, not sure if that includes support workers as they got more power a while ago, parking attendents etc can do you for stuff like illegal U turns etc etc, may be worth looking into, or you can contest the fine if you feel your being picked on

think you can still do it even though you paid yea.
didnt kno community police could hand out fines, the only thing i thought they could do was detail you instead of actually arresting you

These powers will include the right to:

confiscate alcohol in public places

In addition, PCSOs will also be able to draw on further powers at the discretion of their chief constable.

These can include the right to:

detain people suspected of offences
issue fixed penalty notices for disorder, including misuse of fireworks and graffiti
search those suspected of carrying dangerous items

although if you feel like you werent being any of the above, ask for the multistory car park cctv to prove you were driving badly

Sorry to say it dude, but if you payed and signed the citation you have basically said you were guilty.
Says the same on parking tickets, once you have paid you waive your right to contest as payment of fine is accepting the fact your guilty,
take it as a lesson learned for next time :-)

If you are wrongfully detained by a pcso though, you can sue there arses off!, i always just say stuff as i walk past them, like oh wait their not real police lol

I once got told they have rights when i walked past one and said to a mate" i told you it was a lollipop lady." And another was when we walked past one and as we got neerer i went no shes been round the block more times than a pcso" and this one said we dont just do that you know.
